1. About these terms

The website byhypnos.com (the "Site") is operated by Michael Sanford, doing business as Hypnos ("Hypnos", "we", "us" or "our"). These Terms of Service apply whenever you visit the Site or buy from us. By using the Site or placing an order, you agree to these terms. If you don't agree, please don't use the Site.

2. Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to give us accurate, current information when you check out.

3. Our products

Hypnos products are made and shipped by independent third-party makers. We work to describe and show each product accurately, but colors, packaging and labels can differ from what you see on screen, and makers can change their formulas. Always read the label on the product you receive before using it.

4. Not medical advice

Information on the Site is for general information only and is not medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease, and statements about dietary supplements have not been evaluated by the Food and Drug Administration. Talk with a healthcare professional before using any supplement or herbal product, especially if you are pregnant, nursing, taking medication or managing a medical condition.

5. Prices and availability

Prices are shown in US dollars and can change without notice. Products are subject to availability from our makers, and we may limit quantities or stop offering a product at any time. If a product is listed at the wrong price or with wrong information because of an error, we may cancel any order for it and refund you in full.

6. Orders and payment

Your order confirmation email confirms that we received your order; it doesn't mean we have accepted it. We may refuse or cancel any order, for example if a product is unavailable or we suspect fraud, and we'll refund you in full if you were charged. Payments are processed securely by Shopify and our payment providers. Applicable sales tax is calculated at checkout.

7. Shipping, returns and refunds

Our Shipping Policy and our Return and Refund Policy are part of these terms and explain how delivery, returns, cancellations and refunds work.

8. Third parties

Each product is made and shipped by its maker, and any warranty a maker offers comes from that maker. The Site runs on Shopify, and it may link to other websites we don't control. We aren't responsible for third-party websites or their content.

9. Reviews and messages you send us

If you send us a review, comment, photo or other content, you give us permission to use, copy and publish it in connection with Hypnos. You're responsible for what you submit, and it must not be unlawful, misleading, abusive or infringe anyone's rights. We may remove any content at our discretion.

10. Acceptable use

You agree not to use the Site for anything unlawful, to interfere with its security or operation, to collect other people's information, to upload harmful code, or to impersonate anyone.

11. Intellectual property

The Hypnos name, logo and the text, graphics and design of the Site belong to us or our licensors. Product names, images and trademarks belong to their makers. You may not copy or reuse them without permission.

12. Disclaimer

Except as stated in our Return and Refund Policy, the Site and our products are provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

13. Limitation of liability

To the fullest extent allowed by law, Hypnos and its owners will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the product the claim relates to.

14. Indemnity

You agree to defend and hold Hypnos harmless from any claims, losses or costs, including reasonable legal fees, that arise from your breach of these terms or your misuse of the Site.

15. Privacy

Our Privacy Policy explains how we collect and use your personal information.

16. Governing law

These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Missouri.

17. Changes to these terms

We may update these terms from time to time by posting a new version on this page. The version in effect when you place an order applies to that order.
